Most companies include a federal search (direct hit search of USPTO website). Someone could still have rights to the name even if they're not showing up on the USPTO website. We search all 50 state trademark databases & all 50 state corporate databases that are available, common law sources and more to make sure that someone doesn't already own the trademark you're hoping to register before we file. If it's taken, we'll let you swap it out for something else - free of charge.

Most "flat fees" for trademark registration do not include (1) filing fees to the government ($225+); (2) a comprehensive name search ($399); or (3) $700 per response to Office Actions you may receive from the USPTO before your application can be approved. We will file your federal trademark application with the USPTO. Once your application is filed, the government will assign an examining attorney to review your application. We will provide ongoing legal representation throughout the application process until a determination is made or up to a year - whichever comes first.
